Terms of Service

1. What Distressed Signals Is

Distressed Signals ("the Service," "we," "us") is a real estate data intelligence platform. We aggregate publicly available government records — including City of Buffalo code enforcement data and Erie County assessment roll data — and apply proprietary analysis, scoring, and presentation to them. By creating an account or using the Service you agree to these Terms.

2. Not Affiliated with Any Government

Distressed Signals is an independent commercial product. We are not affiliated with, endorsed by, or acting on behalf of the City of Buffalo, Erie County, the State of New York, or any government agency. The underlying records are public; our analysis, scoring, and presentation are our own.

3. Accounts

You must provide accurate information when creating an account and keep your credentials secure. Accounts are for a single user; sharing login credentials or providing access to non-subscribers is prohibited. You must be at least 18 years old to use the Service.

4. Subscriptions and Billing

Free accounts access the Service as described at signup. Paid subscriptions bill monthly in advance and renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and already-billed fees are non-refundable except where required by law. Founding Member pricing remains at the locked rate only while the subscription remains continuously active; if you cancel and later resubscribe, then-current pricing applies. Payments are processed by our payment processor; we do not store your card details.

5. Data Disclaimer — Read This One

The Service presents information derived from public records, which contain errors, omissions, and delays that we do not control. Scores are our analytical opinion, not a statement of fact about any property or owner. THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not warrant that any record is accurate, current, or complete. Independently verify any information before acting on it.

6. Not Professional Advice

Nothing in the Service is legal, financial, tax, or investment advice. Real estate transactions carry substantial risk; consult qualified professionals before making decisions.

7. Your Responsibilities When Contacting Owners

If you use information from the Service to contact property owners — by mail, phone, text, or in person — you are solely responsible for complying with all applicable laws, including telemarketing and do-not-call rules (such as the TCPA), anti-harassment laws, fair-housing laws, and any licensing requirements applicable to your activities. Distressed Signals provides data, not permission to contact anyone.

8. Acceptable Use

You may use the Service for your own business purposes. You may not: resell, redistribute, or republish the data or any substantial portion of it; scrape, crawl, or bulk-extract the Service by automated means; attempt to circumvent access controls or subscription tiers; reverse-engineer the scoring methodology; or use the Service for any unlawful purpose, including harassment or discrimination. We may suspend or terminate accounts that violate these Terms.

9. Intellectual Property

The underlying public records belong to the public. Everything else — the scoring engine, the fused dataset as presented, the software, and the branding — is owned by Distressed Signals. Your subscription grants a limited, non-exclusive, non-transferable license to use the Service while your account is in good standing.

10. Limitation of Liability

To the maximum extent permitted by law, Distressed Signals will not be liable for any indirect, incidental, consequential, or punitive damages, or for lost profits or lost opportunities, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold Distressed Signals harmless from claims arising out of your use of the Service, including your outreach to property owners and your violation of any law or of these Terms.

12. Changes and Termination

We may modify the Service or these Terms; material changes will be posted on this page with an updated effective date, and continued use constitutes acceptance. We may terminate or suspend access for violation of these Terms. You may delete your account at any time by contacting us.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Erie County, New York.
